Regulatory shift to internet-protocol-based broadcasting could leave millions without free over-the-air television

The United States television industry is undergoing another significant technological shift with the introduction of NextGen Television, also known as ATSC 3.0. According to an article published by Engadget on 15 August 2026, the new standard incorporates internet protocols into digital television broadcasting to deliver 4K resolution, enhanced audio, and improved multicasting capabilities. This evolution mirrors the transition from analog to digital that occurred nearly two decades ago, but advocates warn that the current rollout lacks the consumer safeguards previously implemented.

The previous transition to digital television was authorised by Congress in 1996 and mandated by the Federal Communications Commission (FCC) by 2009. At that time, approximately 97.5 per cent of American television-viewing households were prepared for the change, with many utilising digital-to-analog converter boxes or purchasing new televisions with built-in tuners. The move to ATSC 1.0 preserved over-the-air broadcasting, ensuring that roughly 20 per cent of US homes continue to receive free local station broadcasts via antennas today.

Despite the dominance of streaming, which Nielsen data from April 2026 indicates accounts for 47.6 per cent of US viewing habits, over-the-air broadcasts remain a critical source of information for a significant portion of the population. The FCC is currently considering a decision that would allow companies to fully transition to ATSC 3.0 and cease ATSC 1.0 broadcasts. Unlike the 2009 mandate, however, there is no Congress-regulated timeline for this transition, nor are there state-funded educational or coupon efforts to assist consumers in upgrading their equipment.

Concerns are mounting among digital rights advocates that the hasty transition could strip millions of viewers of free public television access. Broadcasters have advocated for the inclusion of digital rights management (DRM) encryption in ATSC 3.0 signals, a move that the Electronic Frontier Foundation warns could effectively privatise public airwaves. Critics argue that such encryption could bar viewers from accessing critical emergency warnings, news, and public service announcements, transforming what has historically been a free service into a restricted one.

John Bergmayer, legal director at Public Knowledge, highlighted the potential social impact of these changes in an op-ed regarding the FCC's ATSC 3.0 transition. He warned that the people most negatively impacted would likely be those who depend most heavily on free public services. Without a regulated timeline or robust consumer support, the growing pains of this transition risk occurring along stark societal lines, further exacerbating existing inequalities in media access.
