Privacy advocates and creators condemn the tech giant’s ‘opt-out’ default for generative image tools

Meta has withdrawn an Instagram feature that permitted users to generate images using the likenesses of public accounts, following three days of intense user backlash. The feature, which allowed users to tag public profiles to create AI-generated imagery, was activated by default, compelling users to actively opt out. This mechanism drew sharp criticism from privacy advocates and creators who described the practice as deceptive. The rapid reversal highlights mounting public frustration with technology firms defaulting generative AI and data-tracking settings to 'opt-out' rather than 'opt-in' models.

The incident began in early July when Meta rolled out the functionality, prompting immediate pushback from the creator community. Multiple Instagram creators posted viral videos explaining how to disable the feature, with one video by creator Sam Sooin Yang garnering over 3 million views. Yang expressed frustration with the company’s approach, stating, "They should have given you the option to opt in rather than opt out. But I am really getting tired of these companies pushing this AI stuff on us when we don’t want to use it."

Meta issued a statement after three days, admitting the feature "missed the mark" and rolling back the Instagram tagging functionality for its AI chatbot. Thorin Klosowski, a senior security and privacy activist at the Electronic Frontier Foundation, noted the speed of the reversal was notable. "That was a clear and immediate pushback," Klosowski said. "Honestly, it was great to see how quickly that happened," adding that three days from activation to removal was a record for such a generative AI feature.

The controversy has intensified calls for stricter federal privacy regulations, with experts noting that the United States currently lacks the comprehensive legal frameworks seen in regions like the European Union. Ben Winters, director of AI and privacy at the Consumer Federation of America, described Meta as a steward of the "opt-out status quo" due to inadequate privacy regulation in the States. Winters argued that the fragmented state laws in California and Maryland are insufficient, calling for centralized federal standards to protect consumers from abusive and deceptive practices at scale.

Legal experts point to Article 25 of the European Union’s General Data Protection Regulation (GDPR) as a model where the more privacy-protective option is pre-selected by default. Woodrow Hartzog, a professor at Boston University’s law school, explained that people tend to stick with default options, meaning automatic enrollment leads to sustained data collection. Hartzog warned that when companies design tools to automatically opt users into AI features, they make realities such as the proliferation of deepfakes more likely, a consequence many users wish to avoid.

In response to the criticism, Meta spokesperson Daniel Roberts stated that the company has built various settings and controls to help people make privacy choices. Roberts added that Meta conducts research through cross-industry organisations like TTC Labs to develop controls and data practices that are easy for people to use and understand. Despite these assurances, the incident has reinforced the view that technology design choices have real-world consequences, prompting demands for a shift in how sensitive features are deployed.
